What Is Cancellation Of Removal And How Does It Fit Into Immigration Court Proceedings?


Cancellation of removal is a legal relief that allows individuals to avoid deportation if they meet specific criteria. This relief can be applicable to both legal permanent residents and non-permanent residents. Successful cases may lead to obtaining legal permanent residency and eventually citizenship when a visa becomes available. There are only 4,000 visas available per year, and applicants must not have committed crimes that would disqualify them. Those who apply can also receive a work permit while their case is pending.


Who Qualifies For Cancellation Of Removal And What Are The Main Requirements?


There are two types of cancellation of removal: 42A for legal permanent residents and 42B for non-legal permanent residents. For 42A, applicants must have been a legal permanent resident for at least five years, have seven years of continuous residence in the U.S. before receiving a Notice to Appear (NTA), and not have committed certain crimes. For 42B, non-legal permanent residents must have ten years of continuous presence in the U.S., demonstrate good moral character, and prove that their removal would cause exceptional hardship to a qualifying relative who is a U.S. citizen or legal permanent resident. Additionally, victims of battery or cruelty by a U.S. citizen or legal permanent resident may qualify through another avenue.

Continuous presence means living in the U.S. for a specified period before the issuance of the NTA or committing certain offenses. For non-legal permanent residents, brief absences are acceptable as long as they do not exceed 90 consecutive days or 180 days in total. For legal permanent residents, the clock starts when they are lawfully admitted and ends with the issuance of the NTA or when committing a disqualifying crime.
